2. SUBJECT OF THE CONTRACT

The subject of this agreement belongs to the SELLER of the BUYER www.prophera.com it is the determination of the rights and obligations of the parties in accordance with the provisions of the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts in relation to the sale and delivery of the product / products that he placed an order electronically from the website, the qualities and sales price of which are specified below.

(Orders placed before 13:00 on weekdays are delivered to cargo on the same day.)

5. GENERAL PROVISIONS

  • 5.1. BUYER, guzelgida.com declares that he has read and has information about the basic qualities of the product subject to the contract, the sales price, the pay method and the preliminary information about the delivery on the website and has given the necessary confirmation in electronic environment.
  • 5.2. If the product subject to the contract is to be delivered to a person / organization other than the BUYER, the SELLER cannot be held responsible for the failure of the person / organization to be delivered to accept delivery.
  • 5.3. The SELLER is responsible for the delivery of the product subject to the contract intact, complete, in accordance with the qualifications specified in the order. In case of damage to the package during cargo delivery, the BUYER is obliged to have a report prepared by the cargo officer.
  • 5.4. If, for any reason, the product price is not paid or is canceled in the bank records, the SELLER shall be deemed relieved of its obligation to deliver the product.
  • 5.5. If the fulfillment of the product or service subject to the order becomes impossible, the SELLER notifies the BUYER within 3 (three) days from the date on which it learns about this situation and returns the total price charged to the BUYER no later than 14 (fourteen) days.


6. RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract without giving any reason and without paying any penalty in distance contracts related to the sale of goods, provided that the product is notified to him or the person / organization at the address he /she shows within 14 (fourteen) days from the date of delivery to the SELLER, provided that he/she notifies the SELLER. The return shipping costs arising from the exercise of the right of withdrawal (in cases where the return is sent via the SELLER's contracted shipping company) shall be borne by the SELLER. The products to be returned must be delivered complete and undamaged, including their box, packaging, and standard accessories, if any.


7. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised in contracts for the delivery of perishable goods such as foodstuffs or goods that may expire. In addition, goods whose protective elements, such as packaging, tape, seal, package, have been opened after delivery; products whose return is not suitable for health and hygiene (food supplements, food with opened packaging, etc.) Refunds are not possible according to the regulations.


8. RESOLUTION OF CONFLICTS

In the implementation of this agreement, Consumer Arbitration Committees in the BUYER's or SELLER's settlement are authorized up to the value announced by the Ministry of Commerce every year, and Consumer Courts are authorized in disputes over this value. The BUYER declares that he has read, understood, accepted all the articles of this agreement and confirms the accuracy of the information contained in the agreement.
